A Victory for a TTT Graduate

TTT stands for third tier toilet. It is a derisive term used for low-ranked law schools or more specifically, schools so lowly ranked that they don’t even get a numbered-ranking but are lumped into the “Third or Fourth Tiers”. People at higher ranked schools (but not quite as high as Harvard, Yale or even UVA) sneer at TTT’s and freely use the term, TTT, in a snide manner. I imagine it makes them feel better about themselves. But yesterday, a TTT graduate stood up to graduates at much higher ranked schools and won.

Linda Drane Burdick University of Pittsburgh Law, Rank 71

Jose Baez St. Thomas Law School , Not ranked (Fourth tier)

Anything in the “Top 100” is considered “first tier.” Granted, Cheney Mason went to U. of Florida Law, but Baez was at the tip of the spear for this defense team. And Baez went to school held in not so high regard in the legal community.

There will be many discussions and debates about the justice (or injustice) in the Casey Anthony Trial Verdict, but it was a big day for TTT alums. On paper, a man who went to a TTT and couldn’t get accreditation by the Florida State Bar for 8 years does not appear to have the “stuff” to win a huge case such as this. The deck appeared to be stacked against Baez. He got a 2-7 off-suit hand to win against a hand with pocket aces and beat the prosecution.

Careers are cemented in big cases like this. The underdog won.

Casey Anthony: Not Guilty on the Big Counts

She is not guilty of first degree murder, manslaughter or felony child neglect. I can't believe she walked on the child neglect charges. A parent with sole custody of a child losing track of her kid for a month can't be anything but neglectful of the child. I'd hate to think Jeff Ashton's personality got in the way of this verdict.

I once saw an interview of Gerry Spence a while ago. One thing a lawyer should not do, Spence said, is to make the jury hate that lawyer. Spence said there were times he thought he was really sticking it to a witness. He said in one case that he was really making a witness squirm. Spence lost the case. A juror later asked him "Why did you make us hate you so much?"

I am curious to see what the jurors will have to say about the lawyers and their perspective on them.

As for Casey, she did something wrong. What will she do now, I don't know. I don't know how she can live a normal life in Florida. Her safety and life are in jeopardy down there. If she knows whats good for her, she would start a new life and move to Maine or Novia Scotia.

Casey Anthony Trial in Jury's Hands

The jury just received the case and a jury watch has started. Here are my predictions, but I won't give any explanation or analysis. These are my gut feelings.

First Degree Murder
Deadlocked or possibly not guilty

Manslaughter
Deadlocked

Child Neglect
Guilty

Lying to a Police Officer (4counts)
Guilty on all accounts. This is the low-hanging fruit. Casey lied through her teeth.

Jury Profiling, Matthew Bartlett and the Casey Anthony Trial

Soon after Matthew Bartlett’s contempt of court incident, I thought about the TV commentators’ ideas on a favorable profile for a juror sympathetic to Casey Anthony. They described the ideal juror for the defense as a young male. I’m not sure if they thought such a guy would have some attraction to Casey which could cloud his objectivity or if the guy simply wouldn’t or couldn’t believe that a woman in his age group could do such a thing. Regardless, Matthew Bartlett appears sympathetic to Casey. He also fits the bill of the demographic the commentators over 5 weeks ago described as a person likely to be favorable to Casey.

Judge Perry Puts the Hammer Down


Judge Perry sentenced a spectator in the Casey Anthony Trial to six days in jail and levied a $600 fine on him, due within six months. The spectator gave the prosecutor the middle finger in the courtroom. Luckily, the jury was not present or the judge would have likely declared a mistrial since it would have prejudiced the jury. Think of the wasted money had that happened.

For 20 min, the judge lectured and questioned the young man, Matthew Bartlett who works at TGI Friday's and lives with his mom. He read the young man the riot act. He could have given the guy 180 days, so the judge showed quite a bit of restraint.

I'm not a fan of Jeff Ashton, but I can't condone what the guy did. He has other outlets to vent his dislikes such as in a blog with low-volume readership!

The Casey Anthony Prosecutor Is a Smug Idiot

Yesterday, a defense witness suggested that a coyote buried Caylee Anthony's remains. The prosecutor, Jeff Ashton, condescendingly said "Oh, a coyote. We aren't blessed with them down here." If you're going to put down someone, then you better have your facts straight, Mr. Prosecutor. Last week in Bradenton, FL, a coyote attacked and killed a 10 year old Maltese. The Maltese owner's neighbors have reported numerous coyote sightings. I guess the prosecutor should eat his words.

(Even though I believe coyotes live in Florida, the witness's theory is quite a whopper.)

Talk about an awful coincidence. This is not the only time Ashton has showed arrogance and disdain to a witness. If jurors are regular people, they may find his snide remarks as off-putting as I do. That prosecutor may be hurting his case because of his personality. We'll see.

I guess someone thinks Jose Baez's strategy in the Casey Anthony Case is a poor one. The Court TV commentators believe he was swinging for the fences. The commentators suggested he could have scaled back the story a little. Baez may have overreached in his defense strategy.

I've noticed something so far in the witnesses called to the stand. I have not seen any strong evidence Casey had premeditated and deliberated in a murder. It looks like the prosecutor is going for a "Susan Smith" type explanation. Susan Smith was the child-killing mother in South Carolina who locked her kids in a car and rolled the car into a lake.

The prosecution had on the stand Casey's boyfriend at the time of Caylee's disappearance. The prosecution is suggesting that the boyfriend did not want to be involved with a woman with kids. In the Susan Smith case, Susan Smith's boyfriend at the time had a similar feeling. What the prosecution will suggest is that the kid was in the way and the murder was a way to get rid of the problem.

So far, the prosecution has not shown strong evidence that Casey premeditated and deliberated.

Nancy Grace Is Going to Blow a Fucking Gasket


I normally don't watch Nancy Grace's crazy ass but tonight I will. I especially detest her after what she did to that guy in the Elizabeth Smart Case, Richard Ricci. Nancy went on a crusade swearing up and down the guy had kidnapped the Utah girl. Ricci had been telling the truth the whole time. Ricci's wife supported her husband's alibi. Nancy called the wife a liar. The cops found a mickey-mouse charge to revoke his parole and sent him back to prison where he later died. Nancy never showed any compunction for her misjudgment.

So, tonight, Nancy Grace will react to Jose Baez's opening statements. Trust me, you don't have to be a Nostradamus to foresee Nancy's going haywire.

Here are the main points she will blast away:
  1. That the father molested Casey
  2. That the brother molested Casey
  3. That the guy who found the body actually was the one who hid it
  4. That Caylee wasn't murdered but actually drowned.
Nancy is going to have  a goddamn stroke.

The Casey Anthony Trial:
A Menendez Type Defense


The defense has claimed Casey Anthony was a sexually abused by her father. The defense further claims Caylee accidentally drowned in the pool. In a panic and in fear of her parents, Casey tried to cover up the accident to avoid her domineering and overbearing parents.

This has a "Menendez" like ring to it. A notable difference is the victim. The parent is not the victim but the granddaughter is. Will this work? Is Jose Baez making up a whopper here? I'm interested to see if the autopsy results support Baez's claims.
